GENERAL TERMS AND CONDITIONS

This document sets forth the terms and conditions under which a Ghis Martel product is delivered to you. This document is legally binding and supersedes all prior contracts or documents. It constitutes the contract between Ghis Martel and the purchaser of the products.
CONTRACT - PRODUCT PURCHASE
TERMS AND CONDITIONS
Definitions
The Supplier is Ghis Martel, whose business address is located at
3-584 rue Bisaillon, St-Jean-Sur-Richelieu, Québec, Canada, J3B1K6.
The Client is the individual or legal entity that signs the online or in-person order form.

General Clauses
Ghis Martel retains the rights to all legitimate materials. The customer may not use Ghis Martel's products or services for illegal purposes, distribute graphic materials or website photos created by Ghis Martel or its affiliates, or produce pirated content. Any distribution, rental, or dissemination of this material must be officially authorized by Ghis Martel.
The Client agrees to protect their password and username from unauthorized use by not disclosing them to anyone and by taking appropriate measures to prevent their disclosure to third parties.
The Client must respect copyright and reproduction rights and must never store, communicate, or facilitate the illegal distribution of Ghis Martel products or elements for which they do not hold the reproduction, copyright, or performance rights, or for which they have not received written authorization from the rights holders.
The Client may not use the trademarks, website name, logo, or any other copyrighted material of Ghis Martel or its affiliates without the express permission of the entity in question.
The Client understands that discussion forums and testimonial pages are spaces for discussing specific topics and that they must respect the themes and etiquette of these pages.
All submitted testimonials are reviewed before publication. This is not a forum but rather a testimonials page. The administration reserves the right to publish those it deems relevant and/or useful.
Cancellation and Refunds
This agreement is subject to Consumer Protection regulations.
Warranty
Due to copyright and reproduction laws, no refunds are permitted on products such as digital versions of works. The only exceptions are if the product is defective, does not meet the Supplier's quality standards, is a royalty-free product, or has not been delivered.
Access Rights and Personal Information
The Supplier agrees to provide the client with the requested services and private access codes. However, it is the Client's responsibility to protect the private access codes provided and never disclose them to any third party. The Client is therefore solely responsible for the proper use of their login credentials.
Access Rights
The Supplier reserves the right to refuse a new registration or access right if it deems that this could pose a threat to the Supplier, clients, or internet users in general, or if the applicant has previously violated the site's terms and conditions. The user may always request a correction of their status or compensation by contacting the administration via registered mail.
Address and Identification Information
To ensure the smooth processing of orders, the Client must ensure their personal information is up to date, including:
- complete name
- complete postal address
- email address
- telephone number
System Integrity
The Client agrees not to attempt to access the Supplier's computer systems, or any government, military, or private network. Failure to do so may result in legal action, and their name and other information concerning their activities may be disclosed to the relevant authorities or judicial bodies.
Accessibility
Due to the characteristics and limitations of the Internet, the Supplier cannot be held responsible in any way for access speeds from other websites, slowdowns, or difficulties accessing the Supplier's website. The Supplier also cannot be held responsible for the non-delivery of emails or discussion forum posts due to the same limitations and characteristics of the Internet. The Supplier reserves the right to temporarily interrupt access to its services for maintenance and/or improvement purposes without any right to compensation. However, the Supplier undertakes to implement all available means to minimize such interruptions.
Security
The Supplier's responsibility is limited to implementing a transaction system that is as secure as possible using an SSL protocol. The Supplier cannot be held liable for purchases if the customer attempts or avoids, whether by mistake or malicious intent, or not using the pages intended for this purpose.
The Supplier will under no circumstances be held liable for any loss, theft, disappearance, damage, or destruction of any personal data in the event of a server provider failure or possible intrusion into the server system outside the Supplier's jurisdiction.
Disclaimer of Warranties
The Supplier's service is provided on an "as available" basis. The Supplier cannot be held liable for any losses, delays, or other issues resulting from the unavailability of products for sale and only undertakes to refund, within thirty days, any items that could not be delivered after full payment has been received.
Copyrights
The Client agrees to respect the copyrights and reproduction rights of Ghis Martel and not to reproduce any work or product of the artist without authorization, whether for sale, loan, dissemination, distribution, or any other purpose.
Cancellation
Any failure or delay in payment by the Client will result in the automatic termination of this contract and the cancellation of the shipment and/or order.
If a product has already been delivered and payment has subsequently been refused or had to be refunded due to bad credit or other reasons, the Client agrees and is obligated to return the product(s) in their original condition as soon as possible and at their own shipping expense, and no later than one month after the transaction date.
Prices and Packages
The prices of the products and services offered are as stated on the order. They are payable in advance in Canadian dollars (CAD). Applicable taxes are extra. The Supplier may change its prices at any time without notice. The Supplier reserves the right to pass on any new tax or any increase in the rate of existing taxes without delay.
